Kavanaugh seems to be quoting Gorsuch that there’s a good argument that Congress CAN’T delegate on major policy decisions to the executive branch, but can on minor ones. And he seems to be encouraging new cases to test that argument. The author wrote an amicus brief on the subject and thinks that DACA is already at the court to use as a test case.
