Seems like grounds for a mistrial. If the defendants made the recordings to expose illegal activity, that is very relevant and the jury deserves to know in order to weigh the merits of the case.
For example, according to the current logic of California and the judge, if someone approached me and wanted to hire me to kill their wife, and I made a recording of it to give to the police, then the murderer could sue me, and the state could prosecute me!
