In most states, there are 2-3 degrees of murder. Don't know about Texas.
In her own words in her own defense she made a point of saying how tired she was after her grueling shift yadda yadda yadda. The text messages show an entirely different story, also known as a lie, and the text messages are completely admissible to impeach the credibility of the witness. It was also presented how she deleted certain incriminating texts in the days after the shooting, also allowed to show the defendant’s state of mind, a guilty person tends to try to hide evidence and it would have weighed heavily on her credibility. None of which is grounds for an appeal.
You are taking the word of a convicted murderer and adulterer.
In Texas, the jury decides the punishment, even in non-capital cases.
The prosecutor, judge and jury disagree with you. What specific evidence supports your position.
Not in Texas; the jury decides within the statutory limits. My guess is 20-30 years. She will likely go to a medium or low security prison.
You are taking the word of a convicted murderer and adulterer.
Well, also the word of the prosecuter and the forensics expert. Unless everyone is lying.
On many occasions I have stepped off the wrong deck on a cruise ship and started walking to my destination without realizing anything was wrong. I can totally see this happening after a long work day and feeling bone tired. Also, perhaps she had tough day on the job . I feel sorry for her and I also feel sorry for the victim, but I truly believe her story.
We shall see.
Because murder has to be premeditated. Simple. She will win on appeal. Today was political.
You will have to ask her for that one.
Not in Texas, which would become abundantly clear, if you read Texas law on such matters.
So too did the lead investigator and the Chief of Police of Dallas. But the judge refused to allow them to testify as to the totality of the evidence and what it said to them - in front of the jury.
I think the fact that the judge didn’t allow the defense to present that even the third-party investigators agreed that the totality of evidence was lacking, is cause for an appeal. Again, we shall see.
So, no evidence, just your opinion of what was in her mind. She could have made her mind up to shoot when she realized someone was in her apartment, that is premeditation. This was the correct verdict and she should get the maximum.
Good for her to get that out and express herself.
The judge specifically instructed the jury that if they were deadlocked between murder and manslaughter, they were to choose the lesser charge. One single juror could have forced a verdict of manslaughter. They were unanimous.
I suspect that making no attempt to help the man after shooting him didn't help. Her uniform was introduced as evidence, and forensics did not find a single drop of blood on it. She never even checked on him! She was busy texting her boyfriend while her victim was dying.
So a home invader can shoot you and it’s only manslaughter?
It would be amazing if she didnt notice anything else in the apartment. She believed she had walked into her apartment in a strange black man was walking towards her.
When Amber was on the stand, she said nothing about him being black.
Why did she not mention that?
