The article is not really about Tesla, but about the rapidly increasing use of arbitration which disadvantages the consumer. Tesla (like other companies using arbitration) pays the arbitration costs, so it’s no surprise that arbitrators find for the company 75% of the time. An arbitrator who finds for the consumer too often will soon find himself out of work.

“The Nagers say they were never presented with a contract or arbitration agreement.” — Right. You can buy a car without a contract. There’s a nice bridge in New York City I should be able to sell them.

“The Nagers say they shouldn’t be bound by a contract they never saw nor signed — whether on paper or online. “I never pushed a button because I didn’t have a button to push,” Debbie Nager says.”

Poor ignorant Debbie! I can’t believe she admitted that for all the world to see.

Just Google “Tesla Purchase Agreement” and you get it. I suspect they just clicked on an “Accept” button not knowing they had just executed their purchase agreement. People are so used to clicking “Accept” online that most people think nothing of it and forget they actually did it. Here is how hard it is to get the Tesla agreement: Click Here.

The article says “Often, the language is buried deep inside a contract or online agreement.” Yes, Tesla really buried it deep in the agreement — go to the top of Page 2:

No doubt. What do those fruit-baskets think that manilla envelope with paper 1/2” thick was that they walked out with? You’ll remember doing the paperwork, even if you didn’t read or listen to a damn thing, because of the writer’s cramp that you’ll have for half a day from signing every page of that contract. (Think it’s bad? Try buying a house!)
