You are missing the obvious. The Texans did it anyway. So too would have anyone else if there was a profit in it, or do you not grasp how profit motivates people to break laws or customs?

There was no profit in it in New Mexico territory (which means Arizona and part of Nevada too.)

There was no profit in it in any of the territories, except perhaps a tiny bit of Kansas.
