How about "the sensible"? Just because you can shoot doesn't mean you should. Law isn't a substitute for common sense.
This prudence should belong to the private property owners sole discretion to be compassionate or not. Just like it is for an officer of the law. On his own private property he IS the law period. Even law enforcement has great restrictions against authority on private property. Yet law enforcement can shoot a trespasser on someone else’s private property at their discretion but the owner of that private property cannot?
