CHARLESTON, W.Va. (WCHS/WVAH) The Kanawha County Prosecuting Attorney's Office has dismissed two charges against a man arrested last week who was accused of assaulting an 82-year-old volunteer at the Women's Health Center in Charleston, according to an order filed Wednesday in Kanawha County Magistrate Court.
Christopher McComas, 52, of St. Albans was charged with assault and disorderly conduct after incident that occurred on July 25 outside the health center at 510 Washington St. W., according to a criminal complaint filed in Kanawha County Magistrate Court.
In the motion to dismiss, prosecutors indicated that, "after careful review of the report, the surveillance video provided and consultation with the victim, the state cannot prove the required elements of the crimes charged."
According to the initial criminal complaint in the case filed by Charleston police, the volunteer is small in stature and weighs about 120 pounds. She serves as an escort, walking patients into the center that offers health services for women, including abortions. The complaint said McComas has been protesting outside of the center for several weeks in a loud and boisterous manner that can be heard by numerous residents nearby.
Police said the volunteer told them she was standing outside when McComas said something about her standing in front of his cooler and quickly moved in her direction.
The complaint said she didnt know what he was doing and felt in fear for her personal safety since he is 30 years younger and weighs 250 pounds. She said she instinctively lowered her umbrella between herself and McComas, attempting to create some separation between the two, telling him to get away from me.

Gee, it read more like she assaulted him with her umbrella. Anyway, glad charges were dismissed.
Have talked to people who were there one told me:
“I was there less than 10 feet away when the so called assault occurred. I saw no such assault! This clinic will say and do anything to get us from coming to pray/protest.”
You all pray for them okay? This is W Va’s last abortion clinic and we want it closed. Since protesters have been there the abortion rate has gone way down!
