To escape using the 5th amendment, and with the key document always conveniently missing, HRC could and did defend herself with a "can't remember" response when forced to answer to her alleged criminal acts. Since Mueller's document source was prominently in view and available, he could not credibly use her defense thus the theatrical performance to elicit pity and sympathy for an old man and his mental deficiencies. But, does anyone really believe he will not complete the NYT's crossword puzzle tomorrow?
