2/ co-conspirator re the conspiracy is admissible even if hearsay. So government wants to call Flynn a co-conspirator to get that out-of-court statement in. The change from "not a co-conspirator to a co-conspirator" is less interesting to me than WHY government doesn't want

3/3to call Flynn now? And I also think it will be interesting because defendant can challenge the admissibility of Flynn's out of court statement in a motion (motion in limine) and argue Flynn wasn't a co-conspirator so it can't come in.

PS From Powell's filing (which only read summary), it appears another basis to have hearsay admitted than co-conspirator label. Need to read legal filings themselves to clarify...have 2 filings due though...so won't be for while. Maybe I should have gotten my Michigan license!

It's kinda the same as Mueller testifying to congress. If he (Flynn) answers truthfully it shows FBI screw up and Flynn never lied in the first place. Flynn has all the info. They need him until this is out and public. If they punish him

Seems clear at this point that Flynn made some kind of deal with Mueller team circa Nov 2017 which led to his guilty plea. Guilty plea meant Mueller team didn't have to show all their (shaky) cards and in return Mueller team agreed to not pursue Flynn's son & other associates

Seems like DOJ lawyers feel that Flynn is reneging on whatever deal he made way back then.

This case is so confusing. If Flynn was set-up or Mueller evidence is flimsy, and DOJ is trying to hide that, why would AG allow this to continue?

They're (Gov't) are not ready to call Gen Flynn now. I don't know what the plan is, but it better be a solid one. Millions of dollars later, his home sold, his reputation and name dragged through the mud is enough already. .... Enough!
