If the HP has not yet written the ticket, he/she has the authority to issue or not, and a warning ticket might be in order for endangering other drivers.
My point is that unless that's the case there is room for a little consideration (judgment being too strong a word) of the circumstances -- especially of obvious factors -- which can be done without compromising either responsibility or the intent of the regulation. I understand this can be abused but that's no reason to preclude thinking before acting (I'd say "using common sense" but this concept is an anachronism in today's society as it is clearly no longer routinely applied in our "modern society".)
