Child bullying. Clear and simple. Good legal case to sue. I'd certainly make an example of the bus driver. Stupidity needs to become expensive again so folks make more of an effort to avoid it.

Guess the bus monitor didn’t see the results of bullying of the kids from Kentucky? Perhaps the school district missed it as well.
