It looks like he might be legal. He had family in NY and San Antonio and moved quite often. He also had a rap sheet for disorderly behavior, especially while intoxicated. I’d give an html link, but I’m on my phone. I searched Mendez, Haverstaw.

Authorities said at a news conference that an argument precipitated the attack, but have not confirmed what it was about.I'm probably going to get royally flamed, but the dad didn't just 'ask', he was hassling the guy about his smoking cigarettes, in his own car, and when the argument escalated, tempers flared and the guy snapped.
Was the driver's actions excusable? Absolutely not. He killed innocent people.
Should the father have hassled the guy about his smoking? Absolutely not!
That said, a lot of people are rabidly anti-smoking and are unafraid to get in someone else's face over it. Unfortunately, the father's family paid with their lives.

A 7-Eleven employee told Eyewitness News that Mendez was smoking outside the store and became enraged when the father asked him not to smoke around the kids.
An argument ensued, which the worker says came to an end when Mendez got into his car and plowed into the 7-Eleven, striking all eight family members.
Police say he then reversed the vehicle and drove forward again, striking the victims a second time.
