He is definitely part of the investigation. Whether or not he is cooperating or not is not clear. It depends on whether he would like to retain his freedom once this is over.
Not sure but I think DOJ has greater control over Ohr while employed at DOJ. Once he leaves he can lawyer up
So if he is cooperating it could be a forced cooperation
