Article 133 of the UCMJ. Conduct unbecoming and Officer and a Gentleman. In these types of matters, officer conduct has always be held to a higher standard than for enlisted personnel.

I agree with bullsnipe, it was conduct “ unbecoming” of an officer. You lose respect of your men by behaving this way and you can’t run a boat if your crew doesn’t respect you. look no further than the lastest incidents in the sea of japan. Root cause of the accidents and deaths of sailors— No Respect of command.

Being retired military myself (31+ years) I don’t want commanders who decide which laws they will obey and which ones they will ignore, especially commanders of nuclear subs holding TS/SCI since they would be subject to blackmail. I’ve had several commanders over the course of my career that decided to break some laws to benefit their personal agendas, including a couple of CICs, and I prefer a boss that obeys the laws of the land. You either obey the law or you’re a hypocrite. The level of law you are allowed to break and it be “ok” isn’t in the eye of the beholder until it violates our constitution, then the lawgiver becomes the lawbreaker.
