I wasn’t applying logic in my last post (#153). Logic often has no place in the American legal system.
I was talking reality. And that point system actually applies. If you defend yourself in public, the DA will look at disparity of force when deciding whether or not to charge you.
And in many respects that’s not fair. Because in the heat of the moment, it’s difficult to decide what is enough, and what is too much.
No matter. The DA won’t care. If you - in the DA’s opinion - overreacted, you are going to be charged. And you’ll be spending big bucks to defend yourself, even if you are acquitted.
I wasn’t contesting your read of the legal system. I was only projecting the consequence of the reality you presented: A society that is destroyed by its own legal system.
