That’s a good strategy. There will be a lawsuit from the DS at the ready but whatever inevitable temporary injunction may follow, it can’t / won’t result in removal of whatever has been completed at that time ;)

I would think that if POTUS signs an EO declaring National Emergency due to humanitarian crisis and other stuff, judges won’t be able to stop it. As in war time.
