And frankly, the burgers don’t cost the store that much, and the guy was likely to get tired of them, or move away, or forget, so the deal they gave him was actually a good idea from their perspective.

So long as they stipulated that he had to be physically present to get the burgers, and that he’d only get one free burger a day, they’d be crazy not to take the deal.

Their bathroom imprisoned him for an hour. They essentially held him hostage. This isn’t some slip-and-fall thing, they couldn’t get the door open either.

Okay...

So we have him

1. Being detained against his wishes.
2. Having emotional distress from the event and the employee’s reaction (laughter).
3. Sustaining a bodily injury.
4. Being lied to by employees who negotiated with him in bad faith.

Were I the legal council of BK, I would say cut that $10K check immediately.

If I were him I’d take the burgers, be grateful, and shut the hell up.

He did, then Burger King reneged on the deal.

Given the overall appearance of a couple of BK’s near my house (and yes, I live in an upper middle class suburb). being offered burgers for life does not sound appealing to me.
