If there’s no doubt whatsoever that he did this, then dispatch him in the same manner. No sense spending any more money on this depraved creature, no appeals, no lengthy prison sentence, no nothing. Just throw him in a hole and dump a truckload of concrete on him. And leave it there as a stark reminder and cautionary tale. Beneath your feet lie the remains of an inhuman creature who kidnapped and killed a three year old boy by encasing him in concrete. His sentence was the same. May God have mercy upon his soul, but his body will remain here in perpetuity.

Unfortunately the Constitution prevents “...Cruel and unusual punishment...”

To me that means only punishments which are both cruel AND unusual are prohibited.

However, the Courts have interpreted that as meaning such punishments from the category “cruel” and the category “unusual” are prohibited. The “and” is interpreted as “or.”

Under my theory there could be cruel or unusual punishments just not both.
