I don’t see why a hearing would be a legal requirement. Who’s going to argue the other side, anyway? Court could be in the bag for Derps, or just think it would be a waste of time. (Maybe FReeQ lawyers will chime in on this.)
BTW, I consider the most significant moment of the Kavanaugh hearing was when LG went off in a completely different direction, apparently with very specific purpose, and drew Kavanaugh out on some points (at the same time educating the entire nation):
1) We ARE at war, and have been since declared by Congress immediately after 911.
2) In time of war, there is a separate system of justice that applies to enemy combatants.
3) Persons have been executed under this military justice system, including some American citizens who attempted to aid Nazi saboteurs acting inside the U.S. in WWII.
4) Finally, LG asked Kavanaugh to confirm his familiarity with Hamdi v. Rumsfeld, 542 U.S. 507 (2004)-—the case which re-affirmed a U.S. citizen who is an enemy combatant (aiding an enemy with whom we are at war) can be dealt with in the Military Justice system (e.g. Gitmo).
I commented to my wife that a lot of people had to be scared silly hearing this. It was like that LITTLE RED LASER DOT appeared on their chest.
I was watching when he started talking about that and it made me sit up and take notice. That just came out of left field from him. Was he sending out a warning based on McCain? Who couldn’t notice that many of the funeral attendees and speakers were absolutely bizarre sounding. Their actions and facial expressions, that they didn’t hide, were not normal based on the decades of funerals I have watched for famous political figures. And what’s up with Kasich? Did he slip up or say that on purpose?
