Let me elaborate.

If the NSA data all passes through or terminates in Utah, a solid argument can be made that the Federal court in Utah is the proper jurisdiction to try the case.

Wow. Civ Pro 101. Subject matter jurisdiction v. Personal jurisdiction. I hated Civ Pro. Interesting, Huber will need a compliant Federal District Court judge. Correct me if Im wrong but wouldnt that be an abuse of discretion standard on appeal, especially if there is dual jurisdiction?
