Let me elaborate.
The first step in many lawsuits is an attempt to defend the suit by asserting that the court doesn’t have “jurisdiction”, in other words that the suit was brought in the wrong court or that the court lacks authority over the subject matter alleged in the suit.
If the NSA data all passes through or terminates in Utah, a solid argument can be made that the Federal court in Utah is the proper jurisdiction to try the case.

Wow. Civ Pro 101. Subject matter jurisdiction v. Personal jurisdiction. I hated Civ Pro. Interesting, Huber will need a compliant Federal District Court judge. Correct me if I’m wrong but wouldn’t that be an abuse of discretion standard on appeal, especially if there is dual jurisdiction?
