I work in a university setting and have had to endure listening to the response “the fact he is an illegal is irrelevant. Its because he is a man that he did this not because he is an illegal”.

Was he charged in state court or federal court? My post 24 is a federal death penalty case. Maybe that is why he is trying to say he is here legally to avoid federal charges.

A question for any criminal attorneys on FR:
Since Iowa law does not allow for capital punishment, why wouldn’t this suspect be prosecuted under the Federal Murder Statute so that there is at least the possibility of him getting the death penalty?

State charges. It all happened in one county, no flight across state lines. I doubt that there are any serious federal charges.
