The statute you cited is the UCMJ which applies to military personnel and a very narrow slice of civilians working ina war zone .

The title of the statute indicates not only that it is in the UCMJ but that it specifically applies to military personnel. Moreover, civilians do not fall under military justice and are covered in other sections of federal code, triable in US federal Courts. The only exception are unlawful combatants fighting the US. They are deemed to be subject to military law when caught.
