Police in suburban Denver kill resident who shot intruder

AURORA, Colo. (AP) — A man who fatally shot an intruder in his suburban Denver home early Monday was killed by responding officers who saw him holding a weapon, investigators said.

Police received multiple calls about a break-in at the home at about 1:30 a.m., and when officers arrived, they heard gunshots inside, The Aurora Sentinel reported .

Aurora police, who described the scene in a statement as “very chaotic and violent,” said they encountered an armed man and fatally shot him. That man turned out to be the person who lived in the home. A second man, the suspected intruder, was found dead during a search.

People are making some quick assumptions here.

First question is who called the cops? Was it the homeowner? If not, was the homeowner expecting the cops at all?

Next question is how did the cops respond? Did they have lights and sirens blaring, or did they come quietly? If they came quietly, and were not expected, it’s possible that the homeowner didn’t even know they were cops...and could well have pointed his gun at them.

Way too many questions at this point.

Put it down. Keep it nearby in case it’s required again. Friendly fire could be an issue also with armed school personnel.

I just took a CCW class and in this situation, the recommendation was to put the weapon down and raise my hands and wait for the police to show and do what they say.
(plus a few other things to say to CYA)

Massad Ayoob wrote a good article a few years back about what to do after a self-defense shooting. Number one is when you are done shooting set your gun down within reach in case you need it again, but don’t hold it. For just this reason.

Second, while just asking for a lawyer is good, there are a couple problems, and a few things you might want to say first. Especially if you shoot someone in self defense outside your home. Police generally form In immediate impression of what happened and if they think you committed a crime it will be very hard to change it later. Just asking for a lawyer is exactly what a criminal would likely do. If you have a CCW permit have it ready. Point out your gun and let them know it’s there. Tell them “I know this is a serious matter and I want to cooperate. I will give a full statement as soon as I consult with my attorney,” Whether you ever give one is irrelevant. It makes you sound like a cooperative citizen, while saying nothing but “I want a lawyer makes you sound like a criminal. It shouldn’t be that way, but it is. Like I said, first impressions.

Finally point out any physical evidence. Don’t count on the cops to find it on their own. For example suppose you are on the street and someone shoots at you and you shoot back. If they don’t find any shell casings they might use that against you. And a shell casing is just the right size to get stuck in the treads of a tactical boot cops wear. Point them out!

The intruder was naked and trying to drown the homeowner’s grandson in the bathtub.

Interesting: The article you linked gave a complete life history on the man protecting his grandson - I thought I was reading a biography - but referred to the intruder only as... the "intruder," like he was a faceless clone stormtrooper or something.

In the article, the wife is outside on the phone talking to the dispatchers.

She gave a full description of her husband and what he was wearing.

Apparently, the officer saw him in the living room while the officer was outside. He then blasted him.

Charge the officer with murder. That is what he did. Let a jury decide to convict or not. My two cents is that he is guilty. Sentence? Not sure, lets here more details.

Unfortunately, there was more going on than meets the eye:

Rathod, who met Tuesday with Jeanette Black and other family members, said the intruder had been attending a party at a home on the corner of North Iola Street and East Montview Boulevard before he ran across the five-lane road and onto the Black’s property. Others from the party followed him onto the property and at some point entered the house, Rathod said.

Black, his wife, a stepson and the grandson were all asleep when the intruder kicked in the door, Rathod said.

Asking the homeowner to disarm in this situation is a bridge too far.

There apparently "others" who also entered the house.

Well, I had my nose broken from a cop. He was in a bad mood asked for my ID and I said I only have a Gideon Bible( was walking about 100 yards to a Denny's). He told me to pull it out and when I did he slammed my face on the back of his car, cuffed me, sent me to the hospital, the threw me in the drunk tank and let me go at 0430 in the morning no papers and twenty miles from my work...so I've had issues but never anything serious. I understand but over all that was the exception. And no I could never find the officer who did that to me or why.

I'm just a poor disabled pensioner. Skills and education but no money anymore. Maybe I wasn't dressed right?

My 2nd son and I were just leaving my mom’s very early Monday morning at approximately 1:30 when we heard what I thought were firecrackers.

Literally seconds later we see cop car after cop car speeding to the scene on Montview. This was the next block over from where we were.

I knew immediately it had to have been a cop shooting when I saw how quickly the cops got there.

Later on Monday, I read an initial news report. I thought the homeowner had been shot by the intruder, and the police shot the intruder. Only later did I see a report with a more info saying the cops actually shot the homeowner.

My mom heard on the news today that the intruder had come in naked and was trying to drown their grandson in the bath tub.

She also heard that the wife had told the police that her husband was wearing a white bathrobe.

What a tragic, terrible, and very weird chain of events.

I was outside of my mom’s one block over when this all went down. My son and I were loading up laundry, into my car, that I had hung out on her line earlier in the day. I thought it was firecrackers at first that I heard. About 5 pops. Then, literally seconds later, cop car after cop car was speeding up Montview. This section of North Aurora can be rough. I live here and hang out at my mom’s just about every day. I grew up in this house.
