He's a Utah politician out to earn points, so he made a meaningless gesture voting for McMuffin. That was a one-time dumb move that has nothing to do with his jurisprudence. If he's pro-constitution and not pro-"penumbra", I'm fine with him. Plus the "great one" digs him. Plus he'll more easily get through the confirmation process and handle all the faux outrage from the dem members, all of whom he knows so well.
