It is a crime for a civilian to lie to any government “agent.” That includes just about everything as the word agent means someone working for. However, it is legal for an agent to lie to a civilian. Thus an FBI agent can say to Marth Stewart that she isn’t under investigation when she is. But it illegal for Marth Stewart to say she didn’t sell stock on insider information if she did.
