He's an interim step. I'm pondering whether or not to study if his opinion on this issue is appealable on an interlocutory basis. I think it is. If he rules one way, there is no trial, so the government has to have a right to appeal. Plus the rarity and gravity of the issue is one that for judicial economy reasons, says "toss it upstairs." It's not like this question comes up once a month.
As long as the case can proceed, no risk to justice. Taking it away from Mueller is no risk to justice.
At any rate, nice to have this matter engaged from all three branches. Pressure is a good thing. Where it pops is unpredictable.
