Let me ask then. With this decision..is it considered a Title 5 ..as if needed any part of the service can be called in. AND if NEEDED a fence(barrier) can be built to ensure the security of the American people? AND can the money then come from the military?

I suppose if LEO's (Border Patrol) needs support by way of a wall, then maybe? I am not a lawyer nor do I play one on TV .
