It darn well could be. My impression (not backed by rigorous lookup) is that the "Secure Fence Act" approved but did not appropriate, and that NO appropriation was ever provided to cause the Secure Fence Act to be implemented. The usual Congressional smoke and mirrors. Nuke it from orbit, we'd be so much better off.
Public Law 110-161, Pages 121 STAT. 2047-48 is the Consolidated Appropriations Act, 2008. The language there is considerably different from what just passed. Relevant only for historical purposes. 1.2 billion appropriated, half of that held back.
This appropriation bill refers to the "Secure Border Initiative," another joke by the federal government, as a chunk of this is to promote a temporary worker program.
