A convicted pedophile who was sentenced to 300 years for sexually assaulting six children has been freed from Arkansas Valley Correctional Facility in Colorado.
Michael McFadden, 46, was released on Tuesday after the Colorado Court of Appeals decided his right to a speedy trial had been violated. McFaddens trial, which was scheduled for 2015, was delayed past the statutory requirements and courts ruled that he could not be retried.
McFadden was released from custody and will not have to register as a sex offender because his convictions were vacated.
We are without remedy, Dan Rubinstein, Mesa County District Attorney, told The Grand Junction Daily Sentinel. "The thing that is so frustrating is that everybody agrees that every decision was made to the benefit of protecting [McFadden's] right to a speedy trial."
After his conviction and sentencing in 2015, McFaddens lawyer sought to add provisions in the juror questionnaire which delayed the trial. An appeals court held in June 2017 that the delay could not be attributed to McFadden and that his case would not be brought to trail again.
In February, the state Supreme Court decided not to hear the appeal which effectively allowed the lower court's ruling, reported USA Today.
Without this additional language in the jury questionnaire, "the trial would have gone forward as originally scheduled. However, under the unique circumstances of this case, we cannot attribute the delay to [McFadden]," Judge Jerry N. Jones wrote in the ruling.
"The prosecutor expressly agreed to the jury questionnaire as drafted by defense counsel, and the trial court accepted it as tendered," Jones added. "Because defendant did not agree to or otherwise occasion a necessary continuance, he cannot be charged with the trial delay."

Huh? It is the defense's fault the trial is delayed and so it is ruled he did not get a speedy trial so he is then set free? These people are morons.
Unfortunately, I am familiar with how this ‘system’ can perform. A few miles from me, across the Golden Gate Bridge, Kate Steinle was killed by an illegal immigrant. The prosecution was flimsy and flabby in that instance too.
He was judged ‘innocent’ of murder.
Yeah, THAT aint happening.

People have patterns. They are creatures of habit. Wait, watch, plan and practice in silence them create and execute a rendezvous with death for this monster. It must be an obsession and must be done alone to be successful but it can be done. It may take years though.

The next time ANYONE mentions gun control, I’m going to hand them a copy of this article. If ever there was an example of the need for protection with deadly force, this is it. Reminds me of that mom in Northern California who walked right into a hearing for the animal that attacked and killed her daughter. She shot him in the head and said he will never do that to another daughter.
My dad worked in a maximum security prison. It was no oversight or neglect.
In Missouri we knew how to deal with fellows that repeatedly beat the law and justice. Look up the book “In Broad Daylight” about Ken McElroy, the bully of Skidmore, Missouri. His lawyer, also named McFaden, but with a different spelling, got Ken off almost 20 times from rape, shootings, rustling, and anything else you can think of.
His neighbors in Skidmore finally had enough and shot him dead on the main street of town one day and then just refused to talk about it for the next thirty-seven years.
A lot of the Kansas City mob moved to homes north of the Columbus Park area and the Northeast area where they grew up and centralized their crime. It was north of the Missouri River in Clay County and McFaden had an office there. A buddy of mine also used that attorney and told me that McFaden could fix almost anything. But he couldn’t keep Ken McElroy from getting killed once the population of Skidmore had had enough.
It appears that the only remedy now is for one of twelve parents — or one sibling or victim — to be willing and able to contribute a single round...

I also met the Trooper who is a central figure in that story. Another friend of mine was a long time good pal of his and he would come down to St. Joseph for lunch occasionally with my buddy that had a business there.
It is still a thing that will shut up an entire bar in that area of the county when someone starts asking about it. You can even get taken out back if you keep it up.
In one season of Dexter, a pedophile makes the mistake of targeting Dexs girlfriends little girl. It was fun watching Dexter stalk and do his serial killer thing on that particular monster.
