Why not hire little people? Doesn’t the lack of little people successfully passing the “fitness” tests prove that the tests themselves are discriminatory?
What about the blind? The FDNY tests discriminate against them also!

Swell. Then let’s apply that to the NBA and NFL. They should look “more like America”. They lack sufficient diversity in that one segment of the population is overrepresented.
Or, play the best players, no matter what they look like or what gender they claim. But if the fire department does the same, it’s bigotry?
