The “National Emergency” allows him to declare Martial Law. Therefore the bad actors can be tried before a military tribunal......and be eligible to be hanged.
Remember they gave GITMO some new paint and handicap access ramps, deployed some new guardsman, from AZ as I recall, and Mattis went there to wish everyone a Merry Christmas ;)
