WOW! Sessions DOJ Moves To Protect Deep State AGAIN, Warns Against Releasing FISA Memo
Gateway Pundit ^ | January 24, 2017 | Joshua Caplan

The Sessions Justice Department is calling on House Intelligence Chairman Devin Nunes (R-CA) to allow the FBI to review the “shocking,” FISA abuse memo to ensure its release will not harm national security.

ABC News reports:

The Justice Department is urging the chairman of the House Intelligence Committee, whose staff has compiled a secret memorandum purporting to show “shocking” political bias within the FBI, to give the department a chance to see the memo and warning that first sharing information from the memo with reporters would be “unprecedented” and dangerous.

Furthermore, the department said certain allegations of impropriety are completely unfounded.

“We believe it would be extraordinarily reckless for the Committee to disclose such information publicly without giving the Department and the FBI the opportunity to review the memorandum and to advise the [committee] of the risk of harm to national security and to ongoing investigations that could come from the public release,” a top Justice Department official wrote in a letter today to Rep. Devin Nunes, R-California.

Hush your mouth - the concern trolls have nothing better to hang their worry hats on. hey ignore that it was literally hours ago that Sessions vowed to do everything possible to recover the "missing" texts and that it is already being reported that they have started the process and have been finding some of the messages....

Concern trolls haven't the ability to grasp the big picture so they harp on little things they can twist to suit their ingrained need to worry. Must suck to be in their heads...

The NY Times didn’t start reporting about Mueller working on an obstruction of justice case before this year.

You really do live in an alternate universe don't you. The primary reason Mueller was appointed was due to the Comey firing, afterTrump stated to Lesrer Holt he was thinking about Russia when he fired him. That was the rationale for possible obstruction of justice, along with Comey's leaked memo. I realize I'm probably your best source of information, and explanation, but it would be a lot less embarrasing for you if you did more study in private.

“You really do live in an alternate universe don’t you. The primary reason Mueller was appointed was due to the Comey firing, afterTrump stated to Lesrer Holt he was thinking about Russia when he fired him”

Well I live in the universe where we read the appointment letter in order to see what’s in it.

In fact Rosenstein’s Order 3915-2017 spells out the primary reason for appointing Mueller special counsel:

“to ensure a full and thorough investigation of the Russian government’s efforts to interfere in the 2016 presidential election”

Notably missing in the order is any mention at all of the firing of Comey. But maybe Rosenstein was writing that part in a secret code decipherable only by the illuminati.

The ability to use the order as a basis for obstruction falls under 28 CFR 600.4- Jurisdiction, which lists possible “federal crimes committed in the course of, and with intent to interfere with, the Special Counsel’s investigation”. Meaning that the crimes listed are process crimes, not the authorized reason for the SC’s investigation.

ORDER NO. 3915-2017
APPOINTMENT OF SPECIAL COUNSEL
TO INVESTIGATE RUSSIAN INTERFERENCE WITH THE
2016 PRESIDENTIAL ELECTION AND RELATED MATTERS

By virtue of the authority vested in me as Acting Attorney General, including 28 U.S.C.§§ 509, 510, and 515, in order to discharge my responsibility to provide supervision and
management of the Department of Justice, and to ensure a full and thorough investigation of the Russian governments efforts to interfere in the 2016 presidential election, I hereby order as follows:

(a) Robert S. Mueller III is appointed to serve as Special Counsel for the United States Department of Justice.

(b) The Special Counsel is authorized to conduct the investigation confirmed by then-FBI Director James B. Comey in testimony before the House Permanent Select Committee on
Intelligence on March 20, 2017, including:

(i) any links and/or coordination between the Russian government and individuals associated with the campaign of President Donald Trump; and

(ii) any matters that arose or may arise directly from the investigation; and

(iii) any other matters within the scope of 28 C.F.R. § 600.4(a).

(c) If the Special Counsel believes it is necessary and appropriate, the Special Counsel is authorized to prosecute federal crimes arising from the investigation of these matters.

(d) Sections 600.4 through 600. l 0 of Title 28 of the Code of Federal Regulations are applicable to the Special Counsel.

Just because Rosenstein didn’t list obstruction specifically doesn’t mean possible obstruction by firing Comey wasn’t the trigger for the special counsel being appointed, as that is well established. I know how hard it is for you believe that Mueller and Rosenstein aren’t the heroes in this story, going all the way back to Uranium One, but until you figure that out you’ll continue to see everything backwards.

“Just because Rosenstein didn’t list obstruction specifically doesn’t mean possible obstruction by firing Comey wasn’t the trigger for the special counsel being appointed, “

Actually it means exactly that.

Which is why the Rosenstein appointment letter expressly states the purpose for appointing the special counsel:

“to ensure a full and thorough investigation of the Russian government’s efforts to interfere in the 2016 presidential election,”

And it never once mentions Comey’s firing or obstruction of justice in the body of the letter.

Obstruction of justice can only come into play under 28 C.F.R. § 600.4(a) which allows the SC to pursue federal crimes that are committed during the course of the SC’s assigned investigation.

“During the course” means that it doesn’t cover events prior to the SC’s appointment. And considering that a president has the legal authority to fire the director of the FBI, firing Comey is not a crime in any case.

You can continue painting your herring red over and over, but you already lost your argument because the obstruction angle goes all the way back to the Mueller appointment, which happened right after Sessions recussed himself. Whether that made your hero Rosenstein’s illegal document doesn’t matter, it is in endless press reports and is the common understanding. That is when is when everyone turned on Sessions, and rightfully so.

Someone who trusts Mueller as completely as you do is just never going to understand.

“Rosenstein’s illegal document “

Now Rosenstein’s official order appointing Mueller special counsel is an “illegal document”.

Priceless.

You just get crazier by the day.

I doubt Sessions had anything to do with this statement. The matter would fall under the area of his recusal.

He seems like a nice old man but underneath that he is either incompetent or complicit.I am at a loss as to why Trump has not gotten a hitter in there unless Sessions is following Trump’s orders.

“Furthermore, the department said certain allegations of impropriety are completely unfounded.”

No problem then, redact the sources and release the memo.

Jeff, you are becoming a great disappointment.

Could you link to your source which declares Rosenstein’s Order No. 3915-2017 to be illegal?

That’s such a remarkable claim. Surely you didn’t decide that all on your own.

Gregg Jarrett was talking about it just last night on Hannity, for one. And yes he’s a lawyer and does play one on TV.

Greg Jarrett has been claiming since May 2017 that collusion isn’t a crime and therefore Team Mueller has no valid reason to exist.

How’s that argument worked out? Any federal judge bought it and disbanded the special counsel?
