Burleson County resident Jimmy Dan Smith and Bastrop County resident Bradley Terwilliger were standing outside the restaurant when the shooting started, Jones said. The lawsuit says the two men immediately took cover, while one of their friends took a stray bullet in the stomach. Terwilliger called Brazos County resident Benjamin Matcek, who was en route to the restaurant, and asked him to pick them up, so they could take their injured friend to the hospital.

When Matcek arrived after the shooting, Jones said, he got permission from Waco police to leave with Terwilliger and Smith and transport their friend to the hospital since there were no ambulances left. The lawsuit states that police documents confirm that's what happened.

After the three men took the injured friend to the hospital, they pulled into the parking lot of a closed business to "regroup and process the traumatic events," according to the lawsuit. While in the parking lot, Waco police approached the vehicle and eventually decided to arrest Matcek, Terwilliger and Smith.

Jones said the motivation for the arrests remains unclear. Waco police did not return a request for comment.

"I'm not even sure that the cops had probable cause to approach them in the first place," Jones said. "Again, I don't know. That sort of fits in with the whole situation that unfolded that day." When they were taken to jail, police knew they were a neutral club and placed them in separate pods from the Bandidos and their supporters, and the Cossacks and their supporters, Jones said.

all we need to know about the gov‘t can be learned from studying the Waco massacre(s).

Anyone who believes gov’t is a force for good deeds should have his head examined

It is going to take a while but I suspect that those who stick it out and don’t plead will make a boatload of money and the county will go broke paying it. It would be even better if a bunch of county officials and police were to be tried and sentenced for setting up and executing the ambush and murdering all those people. That, however, cannot happen. Juries are composed of people who worship police, even police who are openly murderers. Actually, all it takes is one such on a jury.

Richardson was wounded by a large caliber, ricocheted bullet and he told police, “He was glad the cops were there because everything would have been worse if they weren’t.”
