Court of inquiry on Twin Peaks perjury allegations dismissed(Waco)

The judge named for a court of inquiry sought by an attorney for a biker charged in the Twin Peaks shootout on the merits of an accusation of perjury involving police and prosecutors has dismissed the inquiry without ever holding a hearing.

“My decision (to dismiss the court of inquiry) rests on two separate and independent bases,” Judge David Peeples said in an email obtained Thursday by KWTX.

“First, I conclude that the evidence of perjury is insufficient and does not justify continuing the court of inquiry. Second, I continue to have serious prudential concerns about procedure, as was suggested in my earlier emails and in our discussions on Tuesday.”

Peeples did not elaborate on the concerns, but said in the email he will prepare a formal order after the first of the year.

Dallas lawyer F. Clinton Broden presented the request for a court of inquiry to 203rd District Judge Teresa Hawthorne on Oct. 6, and she ruled in his favor, and then asked her administrative judge to order the trial.

The administrative judge selected Peeples who served as the presiding judge for the Fourth Administrative Judicial Region for more than two decades before stepping down earlier this year.

Reyna issued a statement that read: “I am very pleased that Judge Peeples has seen that the Court of Inquiry was baseless and just another attempt by the biker defense attorneys to personally attack me in an effort to distract attention from the truth of what occurred at Twin Peaks.”

Broden issued a statement that read: “I believe I fulfilled my ethical responsibility by bringing this scientifically impossible contradiction in testimony to an impartial judge to determine if a Court of Inquiry should be initiated. I am disappointed that this process was not completed as contemplated by the Code of Criminal Procedure. Having fulfilled my ethical responsibility, I consider my role in this matter to be concluded. Of course, it will be up to any other attorneys aware of the scientifically impossible contradiction in the testimony at the August 8, 2017 to determine whether another Court of Inquiry should be requested so that a decision can be made after a judge takes testimony and evidence on the matter. Likewise, it will be up to the public to compare the testimony from the August 8, 2017 and come to their own conclusions.”

Brown County Sheriff's Dept. - I pulled over a vehicle earlier for a traffic violation on FM 2126. Due to the fact that I was facing the sun as it was setting, I could not read the license plate right away. So, I get out my patrol car to get a better look at the plate, and lo and behold, there is a hot dog on the rear bumper of the vehicle, with a handwritten note saying "free hotdog" with an arrow pointing to the uneaten hot dog. Naturally, my curiosity is raised at this point, and I make contact with the driver. I advised the driver of his traffic violation, and then inquire about his rear bumper.

Driver: funny story actually.. I spent the day in Waco and had some hot dogs for lunch. I set one on the rear bumper and somehow forgot about it and continued running errands around Waco. It wasn't until several people asked about the hot dog, at several different locations, that I realized I had left it on there, so I put a little note on the bumper... I DROVE ALL OVER WACO AND BACK TO BROWNWOOD AND THAT HOT DOG IS STILL THERE!
