And the table busser who said she saw a man wearing a motorcycle helmet with "a big Dirty Harry gun" said the meeting was "a peace rally". Woops -- there goes some of the pre-planned conspiracy angle, for a large percentage of the defendants. All that's left in absence of that is "may be inferred" by a defendants actions (that they took part in "a conspiracy" to commit crime).
Johnson did allow consideration of individual AND "third party" defense TOO, which I saw as a very good sign. If that afforded Carrizal -- to whom else could the same be denied possibility, a distinct possibility for any number of defendants that should be taken into account (could there be reasonable doubt?)
And the gun? The Dirty Harry gun. Which of the 12 firearms that the analyst said were fired (not counting 3 Waco PD rifles) was it? Did anyone show the jury a "big" revolver? The prosecution may have...but Witherspoon, nor others mentioned even a hint of "this" is the gun, or "this could be the gun for the following reasons" etc. It came across to me as a hole in the prosecution's case.
