Lawsuit: Teacher taped shut mouth of student with cerebral palsy

ANN ARBOR, MI (WXYZ/CNN) – In a lawsuit, the family of a woman with cerebral palsy says her former teacher, among others, abused and neglected her over many years while at school.

The 25-page lawsuit, filed against Washtenaw Intermediate School District, a teacher, principal and two teacher’s aides, outlines "repetitive instances of abuse” suffered by Rosa Smith, a now 26-year-old woman with cerebral palsy.

Smith has cognitive impairment, an inability to communicate verbally and physical impairments, including the inability to move her hands and arms.

According to the lawsuit, the woman endured physical, emotional and psychological harm at the hands of the defendants, who allegedly spilled scalding hot coffee on her, locked her in the bathroom for extended periods of time and slapped her across the face.

“These weren’t accidents, and there was abuse going on,” attorney Jonathan Marko said.

I believe it’s federal law that all impaired children be schooled. When I was in nursing school, we spent a day at a school for profoundly mentally disabled kids. (They go past the normal age of 18, to attend school, if I’m not mistaken). Some of the kids I saw were not even trainable, let alone educable. Many were microcephalic, and though they smiled at times, they had little or no capacity to be trained or to learn. Personally, I think sending kids to school all day, when they can’t learn, is more of a badly needed break for the parents. If kids can get anything out of school, well and good. But if they can’t, I think parents who would prefer to keep their kids at home, should be able to do so. God bless those children and their families.

How long is one a child? Is 26 years old a little too old for Middle School?

In my state the cut off age is about 21 or 22 for high school for kids to attend, This is if they flunked a year or have special needs.

26 and in junior high? That is a bit too much for her and her teachers. She should have been pass on years ago and maybe in some sort of day program for people like her. My guess is the school is getting money for her being there all these years. What were they going to do keep her there until she was 30?
