Up until last week, the man who first took a knee had been giving the world the silent treatment.
Even as NFL players knelt in stadiums across America, as President Trump scoffed at them, essentially labelling them a "son of a bitch," and as seismic debates ensued on every network from CNN to Fox News—Colin Kaepernick evaded the bait, opting to let his charitable contributions do the talking.
The onetime rising star and franchise quarterback for the San Francisco 49ers is, of course, without a job.
He has been living in New York City, keeping a low profile and working out, only to occasionally publicly surface at small community events and on TMZ. He has turned down or ignored media requests since January. Even his social media presence has been sparse. An Instagram like here, a retweet there—most of which are related to his equality and social activism instead of his football career.
So, it's been difficult to gauge Kaepernick's feelings every time quarterback-thin squads such as Miami, Tennessee and Green Bay pass on him.
Despite public pressure to sign Kaepernick, who threw for 2,241 yards and 16 touchdowns in 2016, 32 NFL owners have dodged the move so far, under the guise of making football decisions.
Now, Kaepernick is calling them out.
On Oct. 15, through his famed lawyer, Mark Geragos, the 29-year-old Kaepernick filed a grievance against the NFL and its team owners, alleging collusion. They accused the league of essentially cohesively agreeing to blackball him.
While the complaint may force the NFL to be held accountable for collaboratively conspiring, it will likely eradicate any future Kaepernick might have still had in the league.

I have heard of the term HONGCOUVER since the late 90’s. They thought it was a joke back then. The joke is on the white man because the Asians now rule Vancouver. And yes, I love Alberta. Been to Banff 3 times but I prefer Blackcomb..even after the tourists ruined Whistler after the Olympics.

He is apparently suing based on violation of the collective bargaining agreement rather than a distinct legal theory. Here's a good analysis.

It is a violation of pretty much and professional sport league labor agreement to collude in order to suppress salaries or black ball a player. It is a very difficult thing to prove though...
The only time I can remember players getting compensated for collusion was in the late 80’s (baseball) and early 90’s (football). But to get there, the player’s unions had to sue and they had to find memo’s, get testimony from people stating that “we were told to not offer [player x] more than $y” and that number being the same across the team, and/or “we were told to not make offers to any free agent”.
The owners back then were arrogant enough to assume that they would not get called out for it and I am certain they learned to not put anything in writing. Since those two cases, collusion has been alleged a few times; never proven since.
The NFL owners probably never talked among themselves about craperdick. And any GM that went to his owner with a “hey, why don’t we bring craperdick in for a work out?” was told “No, I don’t want him on my team.” That is completely legal. 32 team owners e-mailing each other “NOBODY gives a contract to that SoB” would be collusion. I doubt that happened.
He actually did play last year. He started 11 games after the 49ers had a bellyfull of Blaine Gabbert...
