I just wonder why old things are posted, period. Not timely at all.

That is not the real problem.

The real problem is that someone not well informed is likely to try the same thing in a state other than TX.

In my state, for instance, the cops could take the position that once the car has passed, it is not longer a threat to your life and that therefore shooting at it is shooting at a fleeing suspect. Against the law.

And they would add to the charge of second degree murder a charge that you endangered others on the street with your wild unlawful shooting.

The cops here even charged a store owner because he did not stop fighting the robber when the robber got out the door. The fight in the parking lot resulted in serious injuries to the robber so the store owner was charged.

The laws are full of traps, especially in the area of self defense.

I certainly am not defending these stupid laws. Just saying be careful that you know the law.

Reasonable people could assume they were fleeing to come back again. These are people that were dangerous enough to open up on you and your house. Fleeing is not fleeing if they are still firing. Also that is a huge assumption. I would assume retreaing to regroup. Further he didn’t chase after them. So he was not actively pursuing.
