A DACA-ish proposal would be for President Trump to implement laws he disagrees with by executive order. He wants a 20 percent corporate tax rate? Announce that he will only collect that amount from companies from here on out. He wants to end Obamacare? Announce that no one has to comply with it, and he won’t enforce it.

Obama has set the precedent. Whatever the President wants to do, he can do, and call it prosecutorial discretion.

Interesting start.

Suggested adds / modifications:

1. I would stress that such a thing would be a temporary parole, not immigration.

2. You say, children brought in prior to 13. I would add a minimum of 5 years in the country continuously.

3. I would add to the above that a comprehensive criminal background check, to include sealed juvenile records and sealed school records must be made available. ANY violation (to include smoking in the bathroom while in middle school) is cause for immediate deportation. I would quantify the minor traffic violations to specify that they can have no more than 2 points on their record at any time.

4. I don’t agree with the English proficiency after a one year period. The argument for allowing them to stay is that they are thoroughly inculturated in American life and have no real ties to their country of birth. Make them prove it immediately. No English = No Parole.

5. I would specify that each of them should have quarterly automated criminal checks and an annual face-to-face with a ICE parole officer, along with random house and workplace checks.

6. Rather than saying they have to apply for citizenship from outside the country, what I’d say is that they have to deal with close temporary as above for a minimum of 10 years...then and only then could they be allowed to apply for permanent residence status (green card). Only after 10 year temporary parole AND the 7 year green card status should they be allowed to apply for naturalization.

7. As for no in-state tuition, that is a state matter, not a federal matter. I do agree that they should not be able to take advantage of federal tuition assistance (guaranteed student loans, Pell grants, etc.). I agree on any type of federally-funded social assistance (to include a prohibition on states allowing assistance when a portion of the funding is block-granted by the federal government)

8. I would add that a condition of parole is that they voluntarily agree to be prohibited from owning any real property during the period of their parole (no sense establishing permanent ties to the country if they might have to leave). (Note that I’m talking about real property here, not personal property)

9. I would also apply an end date to eligibility for this program so it is not a magnet. I would insist upon re-authorization every two years until the final end date is reached.

10. If I was POTUS, I would insist that any such temporary parole program would not be signed until the border wall for both northern and southern borders was fully funded and that CBP and ICE be fully funded to allow for illegals that would not be impacted by this parole program could be rapidly identified, incarcerated, and deported within two years.

I would add this one - anyone allowed under the "Daca-ish" program MUST go through a full illegal alien background check if they have not already been FULLY vetted. This article is from June 11, 2013, but it points out how the DACA program was being used under the Obama administration to let pretty much anybody in, regardless of public safety & national security.

There is no need to `re-invent the wheel here’, that is, to give the open borders crowd ammo while showing weakness.
