I am not supporting what the MPD did here but they need be careful what they do if they intend to prosecute him.
While he can refuse to be interviewed by IA and could be fired, what can happen if he is interviewed and gives incriminating statements because he felt compelled to answer in conflict with his 5th amendment rights in criminal matters? Anything he said could be removed from the criminal court record as well as anything that testimony may have led to.
The reason to interview this clown now would be to pin down his statement to exactly what happened in his view. Were I conducting the interview I would give him his 5th rights and ask if he wants to proceed. He says no, go with the facts and fire his ass. Then proceed to grand jury with the partner’s statement, any witnesses, and return an indictment for 2nd degree. I don’t think they would ever get a 1st degree, premeditated, here.
The facts speak for themselves here and there is probably little to be gained from an interview aside from pinning down his defense.
BTW, the firing can be sustained by his use of poor judgment leading to a death and endangering the life of his partner in the shooting. By the time some sorry ass union lawyer can appeal for reinstatement, he should be indicted and awaiting trial. DO NOT PAY THIS CLOWN.
