Congress cannot file criminal charges. They can only refer, which they did. The House Ways and Means Committee voted out a criminal referral to Obama's Department of Justice, which was ignored.

That said, the Republican controlled Congress were complicit in letting the IRS crooks off the hook--some of them were fellow swamp creatures, but most were just plain ineffectual. In a case of this magnitude and import, you just don't throw up your hands and say, "waddya gonna do?" There's more than one way to skin a cat, and waging all out war on every available front should have been the daily order of business. Judicious and creative use of the power of the purse would have been a start.

Once the rule of law collapses, and America becomes resigned to corruption and different sets of laws for politicians, patricians, elites and the rest of America, it's over.

Inherent Contempt of Congress:

Under this process, the procedure for holding a person in contempt involves only the chamber concerned. Following a contempt citation, the person cited is arrested by the Sergeant-at-Arms for the House or Senate, brought to the floor of the chamber, held to answer charges by the presiding officer, and then subjected to punishment as the chamber may dictate (usually imprisonment for punishment reasons, imprisonment for coercive effect, or release from the contempt citation).
