Thank you for posting that. Unlike the vacuous order from the 9th Circuit this order is based in law.
The “vacuous” order was from a federal district court judge in Seattle, not the Ninth Circuit . The appeal of course will be taken to the 9th Cir that has 26 active judges. All depends on the particular three-judge panel that hears the appeal. I suspect, the Ninth Circuit will rule that Washington State has no standing to bring the suit and thus reverse the lower court ruling.
