BS. The regular Army cannot be used for internal insurrection - it's long standing law under the Posse Commitus Act. However, the President can nationalize State National Guard units.

When was the last time National Guard actually fired live rounds on citizens? My recollection is Kent State in the '60's. The NG no longer carries live ammo, as seen in the Rodney King, Democratic Convention, Fergueson, Baltimore, etc, riots. They carry rubber bullets, tear gas, tazers, and other non-lethal devices. Besides, I believe that many Governors would not allow their State Guard to be nationalize without just cause. I'm not worried.

Remember, National Guard is made up of citizen soldiers. You really think they are going to fire on decent, law-abiding armed citizens who are protecting their families and livelihoods?

Don't believe me? Look at the iconic photos of the Koreans standing on their storefront roofs with rifles in hand during the Rodney King riots. NOTHING happened to them when the NG finally moved in. Hell, the cops couldn't even protect the firemen trying to put out the hundreds of fires throughout Los Angeles. The firemen had to give up and let many stores burn to the ground. Politicians are too scared to actually do anything against looters of color.

I'm always amazed that riot police allow the savages to throw rocks, molotov cocktails, and other deadly devices at them, but no longer shoot in self-defense other than some tear gas that gets thrown back. A couple of snipers taking down the scum would have a lasting effect on them. End rant.

That’s solidly over. The NDAA clearly authorized the US Army to conduct operations in the USA including arrest and detention. It further designated the American “homeland” as a battlefield in the war on terror.

You do realize that the Posse Cometitus Act is a hollow feel-good law, right?

18 U.S. Code § 1385 - Use of Army and Air Force as posse comitatus reads:
“Whoever, except in cases and under circumstances expressly authorized by the Constitution or Act of Congress, willfully uses any part of the Army or the Air Force as a posse comitatus or otherwise to execute the laws shall be fined under this title or imprisoned not more than two years, or both.”

The Constitution authorizes Congress the following:
To provide for calling forth the Militia to execute the Laws of the Union, suppress Insurrections and repel Invasions;

Now, given that, and the following laws—
18 U.S. Code § 2384 - Seditious conspiracy
18 U.S. Code § 1918 - Disloyalty and asserting the right to strike against the Government
18 U.S. Code § 2385 - Advocating overthrow of Government
18 U.S. Code § 2383 - Rebellion or insurrection
18 U.S. Code § 2389 - Recruiting for service against United States
18 U.S. Code § 2390 - Enlistment to serve against United States
— can you say that the federal government WOULDN’T consider Athens, TN writ national a “justifiable” cause?

Hmmmm ..?? Didn’t that happen when the 5 police officers were shot in TX (?). I think it was the National Guard who was called out; but I don’t remember if they shot anybody.

However, the President can nationalize State National Guard units.

And state governors can reject the nationalization.
