The case sought a permanent injunction to stop the tollway from using eminent domain to take the land and make way for parts of the new tollway. The case was dismissed in March.

I agree with you about the toll authority. Unfortunately I have found CN to be an equally a-holey company so for me this is like attending a sporting event where your greatest regret is that both sides cannot lose.
Canadian National and Canadian Pacific are different companies.
In some states, railroads have eminent domain authority. Perhaps the railroad should cut a line across the toll road and put up crossing gates, running switch engines back and forth at rush hour.

Never mind. I see this is CP, not CN.
Hunter Harrison was in charge of CN for a while and is now in charge of CP. While they are different companies, CP now has many of the same people that were in charge at CN.
No, it's part of the Milwaukee Railroad.
