No court will find that what the non-court FBI decided in any way establishes a legal precedent. Ever.

Waste of argument. Courts always reject this sort of argument. The fact that somebody else escaped prosecution on the same facts is irrelevant, their case isn't before the court (and even if it was, courts have no duty to be consistent either).
