With "ideological" judges and prosecutors that push the climate change agenda, successful push back against climate change wing nuts will be unlikely. Throw in just one or two unfortunately worded e-mail by a climate change denial think tanks, you have a conspiracy thus a RICO case. Think of it as "legal" legal harassment of those who do not toe the progressive line.

And last I heard, Mark Steyn was having problems with the legal fight back route. He counter sued, gave up his data for discovery, and has been waiting a few years for Mann to respond with his discovery requirements. Unfortunately in our idiocracy the judicial system is completely corrupted. The corrupt DC judge keeps giving Mann more time to respond to discovery. So Mann owns Steyns discovery data and has produced none of his own. This corrupt Oligarchy can not be taken down legally.
