Botanically yes. So are watermelons. In a broader sense, they both have a vegetative soul, and for over 100 years the Supreme Court has recognized the tomato as a vegetable for legal (tax) purposes (Nix vs. Hedden).

But if a tomato self identifies as a vegetable it should be stored in the vegetable bin.
