The Waco Biker Gang Shooting Investigation Is a Complete Mess

It's been nearly a year since nine bikers were killed in a chaotic shootout between the Cossacks and Bandidos gangs at a Twin Peaks restaurant in Waco, and we still don't know much about what happened or who did what. And while 177 bikers were arrested at the scene, we still don' t even totally know which ones will be charged with a crime.

A Waco grand jury handed out 106 indictments in November — a full six months after the shooting — and announced 48 more indictments last month. The indicted bikers were all charged with engaging in organized criminal activity, so it's pretty clear investigators remain unsure who fired the fatal gunshots, otherwise we'd probably see a few murder charges. When the District Attorney's office announced the first round of indictments, it got the number of dead wrong, claiming ten people were killed instead of nine. At least it was able to get that cleared up the second time around.

Whether there will be a third round of indictments is unclear. There are 38 more bikers who were arrested and have yet to be charged. No one seems to be able to agree on what their status is. Houston lawyer Paul Looney, who represents three of the bikers arrested in May, told the Houston Chronicle that all possible charges are automatically dropped against the remaining non-indicted bikers because the grand jury has apparently passed the agreed-upon deadline to hand out indictments in the case. "It timed out," Looney told the Chron on Friday. "Pop the champagne."

cops here in Texas do not go to jail, they were protecting the public dontcha know

And each other's careers. This is the most corrupt smelling thing I have ever seen coming out of Texas since Lyndon Baines Johnson.

To be honest, I live in Texas, even though the locals, swat, Rangers and feds had them staked out this will be a big cover up to protect all the gov employees and you heard it here first all charges will be dropped against the cyclists

hm wonder why? maybe most of the deaths were via the gov.

I believe that is actually a reasonable possibility. To go forward implicates people they don't want implicated.

Average fatality of handgun rounds that hit—25%. About 30% of handgun rounds actually hit their target in a gun fight. That means about 120 rounds would have to be fired from handguns to produce nine expected fatalities.

OTOH, .556 fired by folks standing off at 50-100 yards and aiming with optics would produce nine fatalities with many fewer shots. Maybe with nine shots—maybe fewer given the penetration properties of .556. Fifty yards to center of mass is an easy shot with an AR.

Richard Matthew Jordan II, 31, Pasadena, one gunshot wound to the head. Head: Medium Caliber NOT from police .223

Richard Vincent Kirschner Jr., 47, Wylie, one gunshot wound to the top of the head, one to the left knee and one in the buttocks. Knee: Medium Caliber NOT from police .223; Buttocks: Small Caliber .223 or .22

Wayne Lee Campbell, 43, Fort Worth, one gunshot wound to the head. Trunk: Small Caliber .223 or .22

Trouble started almost immediately, he said: One of the Bandidos, wearing a patch that identified him as a chapter president, ran his bike into a Cossack standing in the parking lot. The Cossack who was hit was a “prospect,” a man in his mid-20s who was “striving to become” a full member of the club.

“They came up really fast, and the prospect turned and faced the bikes,” the Cossack chapter president said. “He fell backward into other [parked] bikes. The guy who hit him stopped and got off of his bike and said, ‘What are you doing? Get . . . out of my way. We’re trying to park.’ ”

Cossacks quickly jumped to the prospect’s defense, he said: “Guys were saying, ‘You’re disrespecting us,’ or, ‘We’re not backing down.’ ”

In a blink, it started, he said: “Two punches: One from them, one from us.” A Bandido with a patch identifying him as sergeant-at-arms of the same chapter threw a punch at Richard Matthew Jordan II, 31, known as “Richie,” who was from Pasadena, Tex. Jordan punched the guy back.

“At that point in time, the sergeant in arms shot Richie point-blank,” the Cossack said.

Police said Jordan died of a gunshot wound to the head.

“Then all the Bandidos standing in the parking lot started pulling guns and shooting at us,” he said.
