Near as I can tell, they had already put at least four rounds into the truck before it left the roadway. Another round came through one of the windows as he exited the vehicle. How did he respond? Well, maybe he was mouthing off, but he walked at least twenty yards through deep snow with his hands as high in the air as he could get them.
So, let’s not pretend that he was the one firing at them. It was them shooting at him, from the moment he rounded that curve in the road.
He never had a gun in his hand, not once, and the only thing he fired off were a few words.
Last time I checked mouthing off is not a capital offense.
I’ve seen no real proof that he was going for a weapon. But even if he was there’s no way the guy who rushed him from the woods and dropped him could have known that. He had his back to him.

And then he made two dramatic movements to get at something under his bulky jacket, while at gunpoint. That’s a “furtive movement”, he was trying to reach for something consistent with reaching for a gun in his left pocket, and police now claim they found a gun in his left pocket. Dunno what video you’re looking at, but what I see is plainly furtive movement by someone apparently trying to live up to his repeated declaration that they’re gonna have to shoot him.
