Did he in fact have a gun, or did the officer just shoot because he had the appearance of reaching for a gun?

Whether or not he was actually armed isn't relevant. He was known to carry a gun, and he made a move that might indicate he was going for one and they shot him. Police shootings under those circumstances have been ruled justified on any number of occasions.

Be that as it may, it still doesn't negate the fact that the officer just shot the man without factually determining if he was actually carrying a gun. Our military, under present Rules of Engagement, can't even do that.

And, if that is the real case, then the officer could be brought up on charges.
